THE “Totoong Narcolist Videos” caused a wave of national discord and discourse. When Malacanang’s matrix hit the news, a fire of controversy especially in the media erupted. In the aftermath of the publication of such matrix by Dante Ang himself in the Manila Times, his editor resigned in protest, decrying such matrix as illegitimate news. It is only one among several high profile conflicts whipped up in the heat of the dispute.

As a lawyer, I was almost burned by the fire of the cause celebre. On 29 April 2019, ex-senator Trillanes personally met me together with his lady staff at the Novotel Hotel in Cubao, Quezon City. As usual, my wife Jo ann A. Fortich was with me.

In the meeting at the hotel lobby, I told Sen. Trillanes to refrain and desist from Bikoy, because it is just a trap, apart from the dire lack of funds even for the ongoing ICC case. Jo ann also told him: “Sir, wag mong itutuloy yan, babagsak ka nyan at di ka na makakabangon.”

That meeting was unusually turbulent. In the few times before in the past more than two years, our meeting had been uneventful. This was markedly different, because Jo ann, for the first time at one point and to my consternation and disbelief, spoke out in a very loud voice against the senator, angrily pointing an accusing finger at him and shedding tears as she lambasted him.

And yet, she was not personally angry with the senator. I had the feeling that she was conveying a dire ominous message like an oracle in antiquity portending of a terrible event to come. Those tears, which were never shed before in the few times that we personally met the senator, underlined a potent portentous prophecy against Bikoy.

That meeting culminates the senator’s actual effort to recruit me as a lawyer for Bikoy, which was first expressed to me on 23 April 2019 through a viber text by his close-in security/staff Jonnel Sangalang.

The text caught me by surprise, because I had absolutely no idea about the senator’s involvement with Bikoy. Jonnel Sangalang represented to me that Bikoy had “handlers” to whom I would be recommended to be his lawyer, and that my task would be to submit a complaint with the Ombudsman following Bikoy’s public revelation that he would soon surface.

I was lucky when a twist of the hand of fate, which I consider as a blessing in disguise, intervened to spare me from the disaster that had befallen instead later on the Flag and IBP lawyers. Two days later or on 25 April 2019, Jonnel Sangalang contacted me again through viber, asking me: “Atty, updated ba ang license mo? After that MCLE?” At that time, he said that he was in a meeting with the supposed “handlers.”

I diligently responded to him by text, stating that an MCLE deficiency, which is just a matter of compliance, does not affect my license as a lawyer, as lawyers are not required to renew their license which is lifetime. Still, he would not believe me, saying “Seriously, really?” obviously in reference to that earlier egregious Warrant of Arrest against me which had been voided by the Court of Appeals on 29 March 2019.

After some thought, I was jolted by the absurdity: I was being recruited to be a lawyer and yet here I was being asked if my license as a lawyer is updated. Beginning to feel an insult and affront on my profession, I began to react negatively, resulting into a nasty exchange of texts between Jonnel and me and causing a lot of emotional distress.

In an effort to placate me, Sen. Trillanes through his lady staff proposed an immediate meeting with me the following day or on 26 April 2019, but I declined, because I was still very much emotionally upset. The senator proposed a meeting instead on 29 April 2019 at Novotel which was the venue later chosen by him. But in the meantime, the damage had become hopelessly irreparable.

In the Novotel meeting, the senator asked me what was wrong about that innocent question coming from a non-lawyer. I presume that question came from him but coursed through his staff Jonnel. According to him, I could just have answered without much ado, but I rejected the senator’s explanation, telling him that the question should never have been asked in the first place.

I told him that they could have conducted due diligence about my lawyer’s license or the license of any lawyer for that matter by asking other lawyers, the IBP, the Supreme Court or the MCLE Committee – but certainly not me. I wonder if a patient would ever go to a doctor for a medical consultation, and dare to ask the doctor if his medical license is updated.

Like any other lawyer who worked hard in law school, for five years in my case as an evening working student in the UP College of Law, not to mention the Bar exams, to earn that lifetime license from the Supreme Court, I rebuffed the Senator, as I deemed the question to be insulting and offensive to me and the whole legal profession.

Although the senator expressed a lame apology for his staff Jonnel, as if the question did not come from him directly, my lawyering for Bikoy was already out of the question.

At the conclusion of that rocky meeting, the Senator’s parting words were: “Sundan na lang ang susunod na kabanata,” which to me were a defiant, firm affirmation of his dogged, grim determination to carry on with Bikoy and reflective of his unwavering belief in Bikoy.

True enough, one week after that meeting, obviously in a bid to influence the outcome of the elections, Bikoy identifying himself as Peter Joemel Advincula held, on 6 May 2019, a solo press conference at the Integrated Bar of the Philippines (IBP) national office.

Although Bikoy was not accompanied by a lawyer, as he still had no lawyer then, the use of the IBP premises lent a weighty air of legitimacy and credence to his press conference. It must have created the popular belief that the national organization of lawyers was backing him.

But matters came to a head when Sen. Sotto, in his press conference, in no time revealed that Bikoy had a similar statement way back in 2016 containing the same narrative against LP personalities including Ninoy Aquino, Mar Roxas and Leila de Lima. This revelation must have doused cold water on fire. As if the fire were extinguished, the IBP declined legal assistance to Bikoy, on the pretext that he failed to qualify.

That was the beginning of the end for Bikoy and his “handlers.” The final nail on the coffin came when Sen. Lacson abruptly recalled his decision to undertake a Senate probe, which must have earlier given Bikoy and his handlers a strong boost of morale.

Not long after the May elections, in a press conference at the PNP Headquarters, Bikoy made a surprise complete turnaround: he disavowed the “Totoong Narcolist Videos” calling them fabricated.

This was eventually followed last July by the PNP criminal charges with the DOJ, an ongoing case, on the basis of Bikoy’s statement, against ex-senator Trillanes, Jonnel Sangalang, and Fr. Albert Alejo S.J., among many others.

Like in the celebrated case of the young peasant girl Joan of Arc whose prophetic words the French King at first refused to heed, Jo ann’s words again proved to be highly prophetic and will resonate into the future: the cause celebre is an abyss with no hope of return.

“As we highlight our accomplishments and milestones in implementing CARP, let us never lose sight of the primary aim of this program, which is to uphold the welfare of our landless farmers, promote social justice, and attain sound rural development through the equitable distribution of all agricultural lands across the country,” sabi ng Pangulo.

“You know, the greatest aberration of land reform was that the Philippines was declared — the whole of the country — as a land reform program area. But they removed Doña Luisita,” pahayag ng Pangulo.

“Far and in between the years that it was fighting, I mean the tenants, marami ho ang namatay. A lot of people died, invested blood just to realize until late today ‘yung mga lupa na dapat sa kanila,” dagdag pa niya.

“I have nothing against the Aquino family — the two presidents and even their family,” ani Dutetre.

Bong Revilla

Sen. Ramon “Bong” Revilla Jr. on Monday said detained Sen. Leila de Lima must not be allowed to participate in Senate proceedings.

“The double standards and sense of entitlement of some people are frankly quite disheartening. When I was incarcerated due to politically motivated charges, which the Court has finally settled in my acquittal, a very vocal group were against my participation in Senate proceedings,” Revilla said, referring to De Lima and her supporters.

Revilla, who was incarcerated on plunder charges from 2014 to 2018, said the Senate leadership at the time of his detention, believed his absence “would have no impact on legislation.”

“Wala ‘yang pinagkaiba sa sitwasyon ko noon. Halatang halata naman ang special treatment ‘pag pinayagan ‘yan ngayon,” he said.

(That’s not different to my situation before. It would be special treatment if she is allowed to participate in Senate proceedings.)

“Equal protection and fair play dictates that Leila De Lima cannot be allowed to participate in Senate proceedings, even if only remotely.”

De Lima, detained on drug charges for more than two years now, has been appealing that she be allowed to participate in Senate proceedings via video conference.

Senators Panfilo Lacson and Franklin Drilon have filed a resolution that would allow De Lima’s participation in relevant Senate proceedings.

Revilla was detained in June 2014 and remained behind bars until his acquittal in his plunder case in December last year. His graft cases remain pending.

From arrest to acquittal: Bong Revilla’s ‘pork barrel’ case
He succeeded in his bid to come back to the Senate, as he vowed to rehabilitate his image which he said was tarnished by his political foes.

On Monday, the eve of De Lima’s 60th birthday, 8 former senators, namely Rene Saguisag, Antonio Trillanes IV, Wigberto Tanada Sr., Sergio Osmena III, Paolo Benigno Aquino IV, Mar Roxas, Francisco “Kit” Tatad, and Benigno Aquino III, announced their support for the resolution seeking to allow De Lima to join Senate proceedings.

“While Senator De Lima is a mere detention prisoner enjoying the Constitutional presumption of innocence, as well as civil and political rights, the fact of her incarceration has prevented her from performing her duties to participate in the legislative process,” the former senators said in a statement.

“To allow Senator De Lima the full discharge of her role and duty as a parliamentarian is to pay respect to the mandate of more than 14 million Filipinos who voted for her into office.”

De Lima was detained in February 2017 due to various drug charges which she said were trumped up by the Duterte administration because of her vocal opposition to its policies, including the war on drugs.

Must Read: Imee Marcos’ UP graduation issue

It should be obvious by now that Imee Marcos, the eldest daughter of the late President Ferdinand Marcos, is running for the Senate in the coming elections. No less than President Rodrigo Duterte himself is campaigning for her.

“ This writer attended that ceremony as a guest of two of the graduates that year.

The surveys consider Imee Marcos as a likely winner in the senatorial race, and the Marcos camp is confident that she will win in the May polls because of the longevity of her incumbency as an elected official.

The surveys consider Imee Marcos as a likely winner in the senatorial race, and the Marcos camp is confident that she will win in the May polls because of the longevity of her incumbency as an elected official.

Imee’s staunch supporters believe she will win also because the Marcos name has regained widespread public acceptability, as demonstrated by the 2010 senatorial victory of her brother, ex-Sen. Ferdinand “Bongbong” Marcos Jr. and his near victory in the vice-presidential derby in 2016.

It cannot also be discounted that their mother, former First Lady Imelda Romualdez Marcos, has held elective public office numerous times since the post-Marcos years.

As in any election, candidates are vulnerable to issues. For Imee Marcos, the issue is about her academic credentials.

The news media has created quite a stir when they questioned Imee’s announcement that she graduated from the University of the Philippines (UP) College of Law in April 1983. From what the news media have so far gathered, Imee’s name is not in the university’s record of graduates as attested to by a top official of the state university.

It is also reported that although Imee’s name does not appear in the 1983 yearbook of the UP College of Law, she is prominently featured in a publication marking the 25th anniversary of the college’s graduating class of 1983.

In support of the assertion that Imee graduated from the UP College of Law, her camp has shown to the news media photographs which show that she participated in a college ceremony held at the Meralco Theater in the Ortigas Center in Pasig in April 1983.

This writer attended that ceremony as a guest of two of the graduates that year. One was an executive of the Philippine National Bank and the other later became a commissioner of the National Labor Relations Commission. Another invited guest was my fellow law student, Dennis Socrates, who is now the vice governor of Palawan.

President and Mrs. Marcos, together with Bongbong, were present at the ceremony, and sat at the front row. The President and his family arrived in a black limousine.

On the stage throughout the ceremony was Dean Froilan Bacungan of the UP College of Law.

The guest speaker of the occasion was then Supreme Court (SC) Associate Justice Hermogenes Concepcion Jr., whose speech was about the constitutionality of executive warrants of arrest.

Other important personalities who also sat in the front row were SC Chief Justice Enrique Fernando and Court of Appeals Justice Serafin Cuevas.

Every graduate went on stage for the usual ritual. Honor graduates were given special acknowledgment on the stage. Imee was given honors.

The ceremony started around 8 in the morning, and ended long after lunch. President and Mrs. Marcos posed for photographs for some of the guests.

Withal, the big mystery concerns the status of Imee Marcos as a graduate of the UP College of Law Class of 1983.

If Imee Marcos is not in the official roster of graduates of the UP, why did the UP College of Law hold a college graduation ceremony at the Meralco Theater in April 1983, with Imee and the members of her family, the college dean and the entire graduating class in attendance?

To repeat, honors were given to the outstanding students present at that ceremony. What will be the status of those honors if the ceremony is bogus?

It isn’t going to be easy for the news media to assert that Imee is not a graduate of the UP, because there was a graduation ceremony held at the Meralco Theater. In the same vein, Imee will have a difficult time insisting she is a graduate of the UP because her name is not in its roster of graduates.

Difficult situations like this allow only one practical way out. The voters should decide, not so much as regards the academic credentials of Imee Marcos, but as to whether or not they want her as senator.

ABS-CBN nangakong magbabayad ng P152.44 Milyon sa BIR to settle tax case

0

Broadcast network ABS-CBN Corporation has agreed to pay P152.44 million as part of a compromise agreement approved by the Court of Tax Appeals in its tax deficiency case.

In a February 27 resolution from the Second Division, the tax appellate court said the Bureau of Internal Revenue has accepted ABS-CBN’s offer to pay the total “judicial compromise amount.”

“The BIR has accepted the amount equivalent to 40 percent of the basic tax assessed for deficiency income tax, value-added tax and documentary stamp tax and the amount equivalent to 100 percent of the basic tax assessed for deficiency expanded withholding tax, compensation withholding tax, and final withholding tax,” the CTA said.

The CTA did not state the total dues of ABS-CBN, but said the amount the corporation agreed to pay represents its alleged tax deficiency for 2009.

ABS-CBN Chief Financial Officer Aldren Cerrado requested for the compromise, according to the CTA.

It said the agreement was granted for the parties to resolve their differences and put an end to the trial, noting the resolution effectively renders judgment on the case.

“After careful scrutiny of the documents submitted by the parties in support of the judicial compromise, the court finds the same in order and in compliance with the established laws, rules and regulations. Hence, the court approves the same,” the CTA said.

Associate Justice Juanito Castaneda Jr. penned the decision and had the concurrence of Associate Justice Cielito Mindaro-Grulla.

Vatican Official Cardinal George Pell found guilty of sex assaults on choirboys

0

Cardinal George Pell faces a lengthy jail term after being found guilty of violent sex assaults against two young choirboys.

After an explosive five-week trial late last year, which has been suppressed until today for legal reasons, the 77-year-old treasurer for the Vatican could now face a sentence of between 10 and 14 years.

Ballarat-born Pell is the most senior Catholic figure in history to be convicted of a crime.

News of his child sex attacks, committed at Melbourne’s St Patrick’s Cathedral in 1996 and 1997 when he was Archbishop of Melbourne, will now heighten the global child sex scandal buffeting the Holy See.

The news comes just days after Pope Francis held a special summit on the child abuse crisis in Rome with more than 190 senior bishops in attendance.

Pell’s barrister Robert Richter has confirmed he has already lodged an appeal against the conviction.

If Pell fails in his appeal against the charges, he will likely be defrocked by Pope Francis.

Despite spending up to $2 million on a top legal team, bankrolled by a trust fund, the Cardinal lost his fight against the charges. He will not return to Rome and may end his days in a jail cell with his name on the sex offender’s register.

The suppression order was lifted today (Tuesday) after a further trial – dubbed ‘The Swimmers’ Trial’ and involving two accusers – collapsed due to lack of evidence.

Those charges, which were dismissed in front of a packed courtroom in Melbourne, related to Pell allegedly groping two boys at a Ballarat swimming pool in the late 1970s.

Pell is due to be remanded in custody at a plea hearing later Wednesday.

He was spared incarceration upon the shock verdict on December 11 last year because he was due to have knee replacement surgery.

A jury of eight men and four women took three and half days to rule unanimously that the Cardinal, who stepped aside from his role in Rome when he was charged by Victoria Police in June 2017, attacked the boys just months after being appointed as Archbishop of Melbourne in 1996.

He was found guilty of five charges, one for penetration of a child under 16 and four of indecent assault involving a child under 16.

Pell looked down in shock as the verdict was handed down at 3.45pm on Tuesday, December 11, at the County Court of Victoria in Melbourne.

During the case, Mark Gibson SC, acting for the Crown, said Pell was still wearing his formal church robes when he caught two boys aged 12 and 13 drinking sacred wine in the priest’s sacristy after mass in St Patrick’s Cathedral, Melbourne.

“He proceeded to remove his robes so to expose his penis,” Mr Gibson said in his opening address of the first trial.

“One of the boys asked, ‘Please let us go’.”

Mr Gibson said Pell then stepped forward and “grabbed” the first boy.

Mr Gibson told how Pell forced the boy into oral sex and then did the same with the other choirboy. He was then accused of touching himself while fondling one of the boys.

About six weeks later, in February 1997, Pell allegedly pushed one of the boys up against a wall in a corridor suddenly, and violently grabbed his private parts.

Both of the boys, one of whom died in 2014 aged 30, cannot be named for legal reasons.

The surviving accuser, a professional and father based in Melbourne, was accused by Mr Richter of “making up lies” and that his testimony was a fantasy or a “false memory he had come to believe over time”.

Mr Richter told the jury Pell was always accompanied at the cathedral and would have been a “madman” to carry out the high risk and brazen attack after a busy mass service.

Pell himself never took to the stand, instead relying on a video of his interview with two Victoria Police detectives in Rome in October 2016.

In the interview he called the allegations an “outrage”.

Previous jury unable to reach a verdict
Today, it can also be finally be revealed for the first time that between August and September last year there was a first trial on the same charges, which resulted in a hung jury, after five and half days of deliberations.

In emotional scenes, three female jurors and one male juror were visibly distraught when the judge dismissed them.

At a committal hearing at Melbourne Magistrate’s Court in March 2018, about 10 charges were dismissed due to lack of evidence – including disturbing allegations that Pell had raped a 10-year-old male orphan in a park, a cinema and on a hilltop.

The orphan had been living at the now-closed St Joseph’s children’s home in Ballarat, but the alleged victim’s dates over when he lived at the home did not support his allegations.

Trillanes charged with sedition raps before Pasay court

0

Criminal charges for inciting to sedition have been filed by Pasay prosecutors against Senator Antonio Trillanes IV for inflammatory statements made by the lawmaker last year shortly after his amnesty was revoked by Malacañang.

In a resolution which accompanied the formal criminal information charge sheet filed before the Pasay Metropolitan trial court (MTC) Branch 44 dated January 30, 2019, Assistant City Prosecutor Reynaldo Ticyado recommended the inciting to sedition charges filed against Trillanes.

The complaint was initiated by Labor Undersecretary Jacinto Paras, Presidential Anti-Corruption Commission Commissioner Manuelito Luna and lawyers Eligio Mallari and Nasser A. Marohomsalic.

The charge, approved by Senior Deputy City Prosecutor Dolores P. Riliera, recommended PHP36,000 bail for Trillanes. However, the complaint for proposal to commit coup d’etat was dismissed for insufficiency of evidence.

The case arose from statements made by Trillanes on Sept. 4, 2018 which included such phrases as “Mr. Duterte, hindi ako takot sa iyo (Mr. Duterte I am not afraid of you)” and “”Itong pangyayari na ito, it should be clear to everyone na si Mr. Duterte ay isang dictator. This shows that we are in a dictatorship where ordinary people are killed and critics jailed).”

Prosecutors said Trillanes cannot claim parliamentary immunity.

“Such privilege under the factual circumstances of this case is not applicable to him considering that the statements made by him, although issued or delivered within the premises of the Philippine Senate, relate to the presidential proclamation revoking the previous grant of amnesty to him and therefore not made while the Senate was in session and in connection with the discharge of his official duties as senator,” they said.

“In the case at bar substantially shown is the fact that the respondent granted an interview by media personalities wherein he issued a statement bearing words tending to instill a feeling of hatred and distrust toward the President of the Philippines and the Government that he represented and which statement was disseminated to the general public thereby creating a breach of peace and public order,” they added.

On Sept. 5, 2018, at the Philippine Senate, Trillanes called on the military and the police not to follow the president’s order by saying “Duterte will not be there for long, please do not do anything illegal or unconstitutional.”
