Robredo should be sanctioned by the courts “SUB JUDICE” rule for commenting on a pending case – Political Analyst

Ayon sa depenisyon, ang SUB JUDICE Rule, among others, is shielding the court from outside influence, and ensuring a fair trial – one based on facts, and not on public opinion.

Aniya, “Robredo should be sanctioned by the courts for commenting on a pending case. She said that the RTC Makati broke the law in issuing warrant of arrest with bail. It is not the impartiality of the judge & his finding on probable cause. Contempt of court! SUB JUDICE rule!”

0

After receiving numerous backlash and criticism from netizens for proposing to tweak some part of the lyrics of the Philippine National Anthem, Senate President Vicente Sotto III is now getting a thumbs up from netizens after proposing to amend a law that is worth revising.

On Monday, Sotto filed the Senate Bill 2026 seeking to lower the age of criminal liability to the age of 13 instead of 15-years-old as stated in the Republic Act 9344 or the Juvenile Justice Welfare Act of 2006 authored by opposition Senator Francis Pangilinan.

Sotto said that he made this move as more minors are getting more involved in illegal activities nowadays; most of them are under syndicates who are taking advantage of the Juvenile Act by using minors to violate the law.

“Due to the continuing challenge in the implementation of RA 9344, as amended, the aforesaid law must be further amended to lower the minimum age of criminal liability in order to adapt to the changing times,” Sotto explained in his explanatory note.

“Not only was the law abused by criminals but the innocence of these youngsters were deliberately taken from them,” he added.

Sotto said that the age 15 is too high not to be held liable in illegal activities, the Senator cited a study by Child Rights International Network which shows that in Asia and Africa, the minimum age for criminal liability is 11-year-old, while 13-year-old in the United States and Europe.

Sotto’s bill seeks to amend the sections 6, 20, 20-A, 20-B, and 22 of Pangilinan’s Juvenile Act, this will make a minor below 18 years of age but above 12-years-old during the commission of a crime be liable to their actions and will be subjected to necessary proceedings.

But in case the child is proven to do the illegal activity without his own judgment, he/she will be exempted from a criminal liability and will undergo intervention programs.

Sotto’s states that the minors could be held liable for crimes such as parricide, murder, infanticide, kidnapping, and homicide.

In case the suspect is between 9 to 12-years old, he will be placed in a special youth facility like Bahay Pag-Asa as stated under the Presidential Decree 603 or the Child and Youth Welfare Code.

When asked to comment about Sotto’s proposal, Presidential Spokesperson Harry Roque said that President Rodrigo Duterte remains true to his position to lower down the age for criminal liability in the country.

“As the spokesperson of the President that is the President’s position, that the Pangilinan law contributed to the rise of criminality. And that’s why the House bill thus provide for measures to be taken against juvenile offenders, they will not get away scot-free,” Roque said.

Pres. Duterte issues order removing non-tariff barriers for agri products

MANILA – President Rodrigo Duterte has signed an administrative order removing non-tariff barriers and streamlining administrative procedures on the importation of basic agricultural commodities.

Under Administrative Order No. 13 which he signed on September 21, Duterte emphasized the “urgent need” to control price spikes of basic agricultural products particularly rice, chicken, pork and fish.

“There is an urgent need to tame price spikes of basic agricultural commodities by adopting measures that remove non-tariff barriers and streamline administrative procedures to allow importation that will address shortfall on supply and ensure stable prices of agricultural products in the domestic market,” the AO stated.

The non-tariff barriers, the AO explains, “unduly add to the costs of importation and limit supply, which in turn, push up the prices of agriculture commodities to the detriment of Filipinos consumers, specially the poor”.

Duterte has directed the National Food Authority (NFA), Sugar Regulatory Administration (SRA), and Department of Agriculture (DA) to ensure implementation of AO13 “subject to conditions imposed by applicable laws and consistent with their respective legal mandates.

In coordination with the Department of Trade and Industry (DTI), the concerned government agencies have been instructed to minimize the processing time of applications for importation.

The President has also directed the agencies to exempt traders that are already accredited from registration requirements and to liberalize issuance of permits.

The NFA and DA have been instructed to facilitate importation of certain agricultural products particularly rice beyond their authorized Minimum Access Volume (MAV) commitment.

Duterte has also directed the DA “to allow importation of adequate volumes of fish” to augment the 17,000 metric tons of fish imports already being distributed in the market”.

To ensure fast delivery of imported agricultural products, Duterte has ordered the Bureau of Customs (BOC) to prioritize the unloading and release of agricultural products.

With the assistance from private sector, the DTI, NFA, Philippine National Police and National Bureau of Investigation shall monitor importation and distribution of agricultural commodities and prevent price manipulation.

In line with Duterte’s order, Executive Secretary Salvador Medialdea has issued Memorandum Order (MO) No. 26 directing the DTI and DA to adopt measures to reduce the gap between farmgate and retail prices of agricultural products.

Medialdea also issued separate MO No. 27 directing the DA, Department of the Interior and Local Government and the Metro Manila Development Authority (MMDA) to come up with measures that would ensure efficient and seamless delivery of imported agriculture and fishery products from the ports to the markets.

The NFA, meanwhile, has also been instructed to “immediately” release to the markets approximately 230,000 metric tons of rice in its warehouses across the country.

“The NFA shall likewise immediately release the 100,000 metric tons of rice previously contracted to be delivered before the end of September,” Medialdea said in a separate memo.

Presidential Spokesperson Harry Roque said Medialdea will check on monthly basis if the agencies have been implementing Duterte’s administrative order.

He said the issuance of AO13 was another proof that the Duterte administration is seriously addressing the high inflation by reducing red tape on importation of agricultural products.

“Ito na po yun katuparan dun sa sinabi ng economic team na they will issue AOs para mapabilis ang pagpasok ng mga inaangkat na pagkain at para masigurado yun mas maagang delivery ng mga inangkat na pagkain sa market (This is the fulfillment of what the economic teams said, that they will issue AOs to fastrack the entry and delivery of imported food to the market),” Roque said in a Palace press briefing on Tuesday.

For many weeks, Metro Manila consumers and even those in other parts of Luzon had to deal with high prices of commodities, particularly farm products due to the onslaught of the typhoon that wreaked havoc to many farms.

To help consumers and to also provide an avenue for farmers to sell their products, the Department of Agriculture (DA) through Sec. Manny Piñol opened TienDA in Manila. The goal of the program is to provide farmers a place to sell their goods without a middle man; thus, the prices for consumers are lower.

Sadly, despite the lower prices of the goods and knowing they are buying directly from the farmers, there were a number of buyers who walked off without paying and simply brought home plastic bags filled with the farmers’ produce.

An angry Piñol took to Facebook to slam these dishonest buyers but also blamed himself for not protecting the farmers more. It was sad that due to the high volume of customers that swarmed the farmer’s market, the farmers were unable to keep track of their customers and were not able to cope with the weighing of the goods as well as collecting the payments.

According to Piñol, the DA had not expected the high number of people who came to the farmer’s market; thus, they were unable to provide enough manpower to assist the farmers.

Sadly, this also gave many dishonest buyers the chance to get their vegetables for ‘free’, not thinking at all about the months of physical and manual labor these farmers had to undergo just to bring these farm products to our tables…

Piñol wrote:

When the TienDA resumes tomorrow with another 20 tons of fruits and vegetables, officials of the Agribusiness Office of the DA will assist farmers in selling their produce in an orderly manner.

As for the farmers who lost their produce to the “veggie-lifters,” they will most likely just shrug it off and say “Charge to experience.”

They have been exploited and shortchanged many times in the past.

I am saddened, however, that this time I failed to protect them.

What makes me sadder is the thought that what happened today could be symptomatic of the erosion of Filipino values.

SC affirms Imelda Marcos’ acquittal in dollar salting case

0

MANILA — The Supreme Court (SC) has affirmed the 2008 ruling of Court of Appeals on the acquittal of former first lady and now Ilocos Norte Rep. Imelda Marcos over her dollar salting case where she allegedly stashed millions of dollars in Swiss bank accounts.

In a 53-page decision, penned by Associate Justice Marvic Leonen, the SC’s Third Division denied the petition for review filed by the late Solicitor General Frank Chavez against Marcos.

Marcos was acquitted of 32 counts of dollar-salting in 2008 by the Manila Regional Trial Court (RTC)) Judge Silvino Pampilo Jr.

Dollar salting is committed when dollars are removed from the Philippines without approval from the Central Bank and transferred to an account outside the county.

In 2007, Pampilo rejected Chavez’s motion for inhibition, which accused the judge of bias largely on the basis of how he scheduled Chavez’s testimony.

The High Court, however, ruled that it is up to the judge if he would inhibit from hearing a case.

“This Court will not require a judge to inhibit himself in the absence of clear and convincing evidence to overcome the presumption that he will dispense justice in accordance with law and evidence. This Court will also not allow itself to become an instrument to paper over fatal errors done by the petitioner and the prosecution in the lower court,” it said.

“It shall always presume that a judge will decide on the merits of the case without bias. Allowing a judge to inhibit without concrete proof of personal interest or any showing that his bias stems from an extrajudicial source will open the floodgates to abuse,” it added.

It also pointed out that there was “no concrete proof of Judge Pampilo’s personal interest in the case was presented.”

The SC also said while Chavez finds fault in the scheduling of his testimony, he did not show how it was irregular.

The High Court said the May 28, 2007 RTC decision and promulgated on March 10, 2008 did not violate the appellate court’s writ of injunction.

When the RTC decision was promulgated, the writ of injunction has already been dissolved.

“Thus, the argument that a subsisting injunction was violated was clearly frivolous, if not misleading, and intended only to make it appear as though the petition has some semblance of basis,” the SC said.

Pampilo then promulgated his Mar. 10, 2008 decision, acquitting Marcos and Rivera due to the prosecution’s “various failures.”

The High Court said the judge found the government’s evidence wanting and based on hearsay, noting that despite the case being anchored on documents from Swiss authorities, only two witnesses with no personal knowledge of the papers were presented.

“Thus, the Regional Trial Court found that the prosecution failed to present competent proof of the alleged offense and of the conspiracy among the accused,” the SC said.

The SC also decided that Chavez failed to provide legal basis to support his argument that Pampilo violated the CA-issued injunction by promulgating the ruling that acquitted Marcos.

“Essentially, petitioner takes issue with how the Court of Appeals interpreted the acts of Judge Pampilo and found no manifest partiality, which are clearly not questions of law. He did not even attempt to frame the issues as questions of law,” the SC said.

The CA first issued on May 22, 2007 a writ of preliminary injunction, stopping Pampilo from proceeding with the case. However, it denied Chavez’s petition on Feb. 28, 2008, due to an insufficient showing of bias and prejudice.
