Morales should explain why she didn’t charge Abaya in MRT Corruption Scandal – Sen. Poe

Conchita Carpio-Morales should explain why she left out former Transportation Secretary Jun Abaya MRT from the Metro Rail Transit Line 3 (MRT-3) maintenance contract mess she filed with the Sandiganbayan.

Last June 26, 2015, the Ombudsman ordered that graft charges be filed against Vitangcol, Soriano, Dela Cruz, Wilson De Vera, Manolo Maralit, and Federico Remo.

In his appeal to the Supreme Court, Vitangcol said: “I am the only DOTC official charged by the Ombudsman despite the unmistakable knowledge, involvement, participation and instruction of my superiors in the DOTC headed by former Sec. Manuel ‘Mar’ A. Roxas II, current Secretary Joseph Emilio ‘Jun’ A. Abaya, Undersecretary for Legal Affairs Atty. Jose Perpetuo M. Lotilla and Undersecretary Rene K. Limcaoco, who should have been the ones brought to justice for gross and inexcusable inaction if not willful and deliberate manipulation of the events and processes related to the maintenance of MRT.”

Poe said she was puzzled why former MRT-3 General Manager Al Vitangcol was the only transport official charged by Morales.

Poe planned to invite both Vitangcol and Abaya in a May 23 hearing of the Senate committee on public services which she chaired.

TP RJ Nieto to Trillanes: No masaya kame naka detain siya, and I’m entitled to my own Political Opinion

“barking in a wrong tree si trillanes at even si Bam kay Mocha”

TP:no masya kame naka detain sya 。and I’m entitled to my own political opinion!

Trillanes: “You are entitled to your own sick opinion”

No More, Madam Claudia, Pinoy Ako Blog at etc.

So Huli ka balbon!

UPDATE:

The main problem here is the anonymity of blogs like Silent No More PH. They seem to present themselves as persons who fight for the people but they use their anonymity as an escape from their accountability. How can we believe the words of people who cannot stand for their words, how can we believe that they truly express the voice of the people and fight for the public if they cannot even fight for their own voice? We fight for every word that we post, Same goes for Sass Rogando Sasot, RJ Nieto, mocha who unmasked themselves  and revealed on their blogs Thinking Pinoy, Atty. Bruce Rivera, Atty. Trixie Cruz-Angeles, Maharlika, Mr. Riyoh and all known pro-Duterte bloggers. The funny thing is that those who tag us as propagators of fake news are the ones who are hiding themselves.

Trillanes kin got MRT-3 contract

0

Expect crony transport firms too to cry “vindictiveness.” Yet like the abusive SR Metals nickel miner of the Aquino regime, they need to be punished. Well documented are the injuries they have caused train commuters in frequent accidents. Incalculable is their damage to the economy – the fuel, health, and opportunities lost in years of traffic that they wrought. They got away with it because owned by members of the Liberal Party of Noynoy Aquino, Mar Roxas, and Transport Sec. Joseph Abaya. One is owned by relatives of the regime’s attack dog, Sen. Antonio Trillanes. Dossiers have been handed to President-elect Rodrigo Duterte, who vows justice for long oppressed citizens.

It all began with the sudden dismissal in 2012 of longtime MRT-3 maintenance firm Sumitomo. In lieu of the Japanese giant was hired, sans public bidding, two-month-old inexperienced PH Trams. Undercapitalized at only P625,000 paid up, the newcomer was given a monthly fee of $1.15 million (P53.5 million). Bringing in CommBuilders and Transport (CB&T) as partner didn’t help, despite the latter’s many years as manpower provider for the sister LRT-1. For, PH Trams simply pocketed the fees instead of buying the spare parts.

So began the slide of MRT-3 from 72 coaches then to only 34 today. Rail tracks, power supply, and signaling system deteriorated. Not even the toilets, elevators, and escalators at the stations worked. Accidents and breakdowns shut off operations every other day. Riders had to endure long lines under the sun and rain for trains that never arrived.

PH Trams is owned by, among others, Marlo dela Cruz and Wilson de Vera, LP leaders and 2010 campaigners for Aquino and Roxas in Pangasinan. Three other incorporators are Roxas supporters Manolo Maralit, Federico Remo and Arturo Soriano. That Soriano turned out to be the uncle-in-law of then-MRT-3 general manager Al Vitangcol caused the latter’s ouster in 2014. Still, as Vitangcol now exposes, it was Roxas as transport chief who quietly had brought in PH Trams. Just that, when Roxas had to move to the Dept. of Interior, it was Abaya who signed the contract two days in as replacement.

Ten months later, when PH Trams’ owners were linked to the shake down of the original MRT-3 train maker, Abaya had to replace it. Newly revived Global Epcom, formerly Genials Inc., was hired – again by closed-door haggling instead of open bidding. To make it look legit, Autre Porte Technique (APT), the old maintenance firm of LRT-2, was tapped as partner. Still it didn’t work. Global Epcom, like predecessor PH Trams, wouldn’t buy the spare parts for use by APT’s upkeep personnel.

It turned out from records that Global too was controlled by Marlo dela Cruz. Reported as silent partner was none other than Alan Dilay, Abaya’s chosen general manager of the Philippine National Railways. As expected from the crony contracting, the MRT-3 worsened in the next two years. Same with LRT-1 and -2 under Abaya’s pals. With commuter rails malfunctioning, traffic jammed across the megalopolis. Invoking crisis, Abaya got Congress to subsidize billions of pesos for maintenance and equipment. Then, with no public hearing, he raised train fares 50 to 90 percent in Jan. 2015.

Abaya was unstoppable. Rigging the 2013 bidding for new MRT-3 coaches, he granted the P3.85-billion deal to an unqualified Chinese firm. The prototype that arrived had no engine; three subsequent coaches were untested for 5,000 km.; all were substandard – in breach of contract. Vitangcol swears there was five-percent kickback, or nearly P200 million. He exposes the agent, Eugene Rapanut, LP-Ilocos card-carrying member.

In July 2015 Abaya temporarily replaced Global Epcom with seven subcontractors. It was assigned only to cleaning the stations. Five others were given the trains and signaling, power supply, rail tracks, elevators-escalators, and ticketing. The P53.5-million monthly fee doubled in the next six months.

The seventh subcontractor, TriLink Technologies, inexperienced in railways, was tapped for communications systems. With no public bidding it was awarded P7.28 million. SEC documents show that TriLink has Henry Iriola Trillanes as incorporator-president-CEO. Five other Trillaneses are incorporator-officers, with the same address. Comelec records identify Henry as the biggest contributor to the 2013 senatorial campaign of Antonio Trillanes IV. The latter, like Abaya, used to be a naval officer. He was the hit man against Roxas’s rivals for the Presidency, Jejomar Binay and Duterte.

In Aug. 2015 Abaya held secret talks for the three-year, P4.25-billion maintenance of MRT-3. In Jan. 2016 he awarded it to Busan Transport of Korea and four Filipino dummies. The consortium has odd arrangements. Giant Busan, with $38 billion assets, supposedly owns only two percent. The 98 percent is held by the four locals whose combined worth, P1.1 billion, is way below the required half of the P4.25-billion contract price.

The four are into anything but railways. Edison Development Construction Corp. is into real estate, Tramat Mercantile into agricultural supply, TMI Corp. into trading, and Castan Corp. into plumbing. Most of all, DOTC sources aver, behind the four are the same old LP contractors in MRT-3: Marlo dela Cruz and Eugene Rapanut.

No wonder that, despite the vaunted entry five months ago of a Korean rail expert, MRT-3 service still is below par. In the past four days alone the commuter trains bogged down five times.

Janet asked to reveal Noy’s ‘involvement’ in Malampaya fund misuse

0

The Pambansang Lakas ng Kilusang Mamamalakaya ng Pilipinas (Pamalakaya) yesterday urged alleged pork barrel scam mastermind Janet Lim-Napoles to spill the beans on the supposed involvement of President Aquino and other officials in the misuse of Malampaya funds, which were reportedly coursed through her bogus NGOs.

In a statement, Pamalakaya vice chairman Salvador France said the new plunder case filed by the Kilusang Magbubukid ng Pilipinas (KMP) against the President, Budget Secretary Florencio Abad, Agrarian Reform Secretary Virgilio de los Reyes and other officials over the Malampaya funds misuse should compel Napoles to reveal her dealings with the administration.

For the sake of truth, justice and transparency, Mrs. Napoles is hereby required by the Filipino people to tell the truth and nothing but the truth. Mrs. Napoles, it is time to tell all, bare all, he added.

France also noted that the Malampaya funds misuse shows that the Aquino administration merely continued the high crimes of corruption of the previous administration in collusion with Napoles bogus non-government organizations.

The KMP plunder cases against Aquino and the rest of the ruling gangland in malakanyang manifest the high involvement of Aquino and company in murderous crimes of plunder of taxpayers money, which are more revolting and more devastating compared to the plunder crimes of the past, he added.

In a 16-page complaint, KMP said Aquino committed plunder when he approved the release of P125 million in Malampaya funds for projects or purposes not in accord with the law. Also included in the complaint are whistle-blower Benhur Luy, former Department of Agrarian Reform undersecretary Narciso Nieto; DAR Undersecretary Jerry Pacturan of the department’s Support Services Office; Department of Budget and Management Undersecretary Mario Relampagos; Teresita Reyes; Ashley Baul; Simplicio Gumafelex; John Raymund de Asis; John Lim, and Nemesio Pablo Jr.

DAR and was used in 2009, prior to the transition of administration in mid-2010.

Parungao also stressed that the present DAR administration took the initiative to look into the apparent exploitation of the funds even before it came out in the news.

After receiving reports that some of the supposed beneficiaries of the Malampaya Fund denied having received any financial assistance or support from the DAR back in 2009, the Office of the Secretary directed its Internal Audit Service on November 2012 to conduct an investigation, which began the following month, he said.

He said that the DAR then turned over copies of the documents it collected both to the Commission on Audit, which conducted its own special investigation on the matter, and to the National Bureau of Investigation.

The DAR has shown its readiness and willingness to cooperate in any investigation on the Malampaya fund issue, Parungao said. “Incidentally, there were fund releases back in 2011. “ With Rhodina Villanueva

De Lima Left DOJ With Over P123.8M in Unliquidated Confidential Funds, COA Report Says

Former Justice Secretary Leila de Lima may have secured a seat in the Senate, but according to the Commission on Audit (COA), she left the Department of Justice (DOJ) with P123.8 million in confidential funds that remained unliquidated.

In its 2015 Annual Audit Report, posted on the COA’s official website, the agency stated that the amount represented unliquidated cash advances released to Special Disbursing Officers (SDOs) for confidential funds during the year.

The COA’s verification and analysis showed that from January 1 to December 31, 2015, the DOJ released a total of P173,755,064.92 in confidential fund cash advances to SDOs. However, only P49,943,081.57 had been properly liquidated.

As a result, P123,811,983.35 remained unliquidated at the time of the audit.

The audit also found that some SDOs received additional cash advances even though they had not yet submitted liquidation reports for their previous advances. The COA noted that this practice violated Section 6.1.5 of COA–Department of Budget and Management Joint Circular No. 2015-01, which prohibits the release of subsequent cash advances until earlier ones have been fully accounted for.
